Identificar las limitaciones de los contratos petroleros y contemplar alternativas para mejorar las inversiones en el Perú

Abstract

El Perú como otros países del mundo se esfuerzan para organizar, promocionar y licitar mediante rondas petroleras, los Contratos Petroleros (Licencia, Operaciones, Servicios, etc.) con la intención de atraer las inversiones y se ejecuten actividades de exploración y explotación de Hidrocarburos, y ello nos permita poder descubrir nuevas reservas económicas de hidrocarburos en beneficio del Estado (Regalías, canon, sobre canon, etc.). Sin embargo, en oportunidades estos esfuerzos se caen, debido a que los modelos de Contratos Petroleros, las políticas aplicadas y la legislación vigente al sector hidrocarburos que propone cada Estado no sean atractivos para el inversionista. En por tal razón que, presentamos el siguiente proyecto de tesis en la que evaluaremos y realizaremos un estudio a detalle de los modelos de Contratos petroleros del Perú (Noroeste, Selva, Costa, Zócalo y Sierra) respecto a otros modelos de Contratos de países de la región (México, Colombia, Brasil, Argentina, Ecuador, Bolivia y Venezuela). Para ello, se hará uso de información pública (Legislación de hidrocarburos, aspectos técnicos, económicos, social y ambiental); así como, la revisión de artículos científicos, estudios de investigación y estadísticas publicadas en medios web estatales para identificar las limitaciones que existen en los Contratos petroleros para proponer alternativas que mejoren las inversiones de hidrocarburos en el Perú. Finalmente, consideramos que este proyecto servirá de apoyo para el Estado y corresponderá a los directivos y ejecutivos estatales tomar las decisiones para atraer las inversiones en actividades de hidrocarburos que beneficien al Perú, respetando siempre a las Comunidades y medio ambiente de cada región.

For this reason, we present the following thesis project in which a detailed study of the oil Contract models of Peru (Northwest, Jungle, Coast, Zócalo and Sierra) has been evaluated and carried out with respect to other models of Oil Contracts. countries in the region (Mexico, Colombia, Brazil, Argentina, Ecuador, Bolivia and Venezuela). For this purpose, public information will be used (hydrocarbon legislation, technical, economic, social and environmental aspects); as well as the review of scientific articles, research studies and statistics published in state web media to identify the limitations of oil Contracts and consider alternatives to improve hydrocarbon investments in Peru. Finally, we consider that this project will be of great support for the State and the hydrocarbon sector, and it will be up to the state or private directors and executives to make decisions that benefit Peru, always respecting the Communities and environment of each region.
